April 2024 Class Action Settlements Involve Verizon, Subaru, Kia & Hyundai

AMC+ privacy violations $8.3M class action lawsuit settlement

AMC agreed to a $8.3 million settlement to resolve claims that its video-streaming websites collect user information and activity data through pixel tracking without consent.

The settlement benefits individuals who watched videos through AMC+, Shudder, Acorn TV, ALLBLK, SundanceNow and/or HIDIVE services on an online website, mobile app or AMC streaming service between Jan. 18, 2021, and Jan. 10, 2024.

According to the class action lawsuit, AMC used Meta Pixel tracking to track user activity on its streaming websites. Plaintiffs claimed AMC tracked this information without their consent, in violation of the federal Video Privacy Protection Act (VPPA).

The deadline to file a claim in the settlement is April 9, 2024.

Kia, Hyundai engine failure class action settlement

Kia agreed to pay an undisclosed sum to resolve a class action claiming certain Kia and Hyundai vehicles are plagued with engine defects that can lead to fires and total engine failure.

The settlement benefits owners and lessees of certain Hyundai and Kia vehicles.

Plaintiffs in the class action lawsuit claim the car manufacturer equipped its vehicles with defective engines. Defects in the engines’ parts allegedly caused engine seizures, stalling, engine failure and engine fires that Kia’s warranty did not always cover.

The deadline to file a claim in the settlement is April 5, 2024.

Smithfield pork indirect purchasers antitrust $75M class action settlement

Smithfield agreed to pay $75 million to resolve claims it conspired with other pork manufacturers to raise and fix the price of pork products.

The settlement benefits indirect purchasers of pork products manufactured by JBS USA Food, Clemens Family, Hormel, Seaboard, Smithfield, Triumph, Tyson and Agri Stats between Jan. 1, 2009, and April 2, 2021.

According to the class action lawsuit, Smithfield conspired with numerous other pork companies to raise and fix the price of processed pork products. Plaintiffs claim indirect purchasers were financially injured when they were forced to pay a higher price for these products at grocery stores and other retailers.

The claim deadline is April 2, 2024.

JBS indirect purchaser pork prices $20M class action settlement

JBS USA Pork agreed to pay $20 million to resolve claims that it conspired with various other pork companies to raise the price of pork products.

The settlement benefits indirect purchasers of various pork products in certain states between Jan. 1, 2009, and April 2, 2021.

JBS USA Pork allegedly conspired with other pork manufacturers to raise and fix the price of pork products, violating federal and state antitrust laws. As a result of this scheme, consumers such as the plaintiffs were overcharged for pork, the class action lawsuit contends.

The deadline to submit a claim in the settlement is April 2, 2024.

Subaru Ascent CVT class action settlement

Subaru agreed to a class action lawsuit settlement to resolve allegations that its Ascent vehicles had defective transmissions that could lead to significant repair costs.

The settlement benefits current and former owners and lessees of 2019 to 2020 Subaru Ascent vehicles.

Plaintiffs in the class action lawsuit claim their Ascent vehicles were equipped with defective continuously variable transmission (CVT) systems. These transmissions were allegedly prone to jerking, lurching, power loss and other problems that resulted in significant repair bills for drivers.

The deadline to submit a claim in the settlement is April 15, 2024.

Verizon administrative fees $100M class action settlement

Verizon Wireless agreed to pay $100 million to resolve claims it charged unfair administrative fees it did not properly disclose to consumers.

The settlement benefits current and former Verizon account holders who paid administrative charges and/or administrative and telco recovery charges between Jan. 1, 2016, and Nov. 8, 2023.

According to the class action lawsuit, Verizon failed to disclose certain administrative fees it charged as a part of its postpaid wireless service plans. Plaintiffs claim these fees were not part of the original advertised price for the postpaid wireless service plans.

The deadline to file a claim in the settlement is April 15, 2024.

Audi oil consumption class action settlement

Volkswagen agreed to a class action lawsuit settlement to resolve claims that certain Audi vehicles had engines with defective pistons.

The settlement benefits current and former owners and lessees of 2012-2014 Audi A4; 2012-2014 Audi A5; 2012-2014 Audi A6; 2012-2014 Audi Q5; 2012-2014 and 2016-2017 Audi TT; and 2015-2017 Audi A3 vehicles.

Plaintiffs in the class action lawsuit claim Audi vehicles had engines with defective pistons and piston rings that caused them to consume too much oil. According to the class action lawsuit, excess oil consumption caused frequent oil changes and, in some cases, engine damage.

The claim deadline is April 15, 2024.

Lincare Holdings data breach $7.25M class action settlement

Lincare Holdings agreed to pay $7.25 million to resolve claims it failed to prevent a 2021 data breach that compromised consumer data.

The settlement benefits individuals whose personal information was stored by Lincare Holdings and potentially compromised in the September 2021 data breach.

According to the class action lawsuit, a data breach in September 2021 compromised patient personal information and health data stored by Lincare Holdings. Plaintiffs argue Lincare could have prevented the data breach by implementing reasonable cybersecurity measures.

The deadline to file a claim in the settlement is April 15, 2024.

Astroworld Magic Money $335K class action settlement

Magic Money agreed to pay $335,000 to resolve claims that it didn’t refund customers for currency to use at the canceled Astroworld Festival in November 2021.

The settlement benefits consumers who purchased Magic Money for the Astroworld Festival 2021 and who did not receive a chargeback or refund for their purchase.

Plaintiffs in the class action lawsuit claim Magic Money should have refunded them for currency they purchased but were unable to use at the Astroworld Festival in Houston in November 2021. The second day of the festival was canceled after a crowd crush killed 10 people and injured hundreds on the first day.

The claim submission deadline is April 9, 2024.

Blackhawk Network data breach $985K class action settlement

Blackhawk Network agreed to pay $985,000 to resolve claims that its negligence caused a 2022 data breach that compromised sensitive consumer information.

The settlement benefits consumers whose information was compromised in the Blackhawk data breach in October 2022 and those who received a data breach notification from Blackhawk.

According to the class action lawsuit, Blackhawk could have prevented an October 2022 data breach if it implemented reasonable cybersecurity measures. Plaintiffs in the case argue hackers were able to gain access to consumer information as a result of Blackhawk’s negligence.

The deadline to file a claim in the settlement is April 11, 2024.
