June 2025 Class Action Settlements Involve MGM Resorts, DSW and UnitedHealth
Ten settlements are accepting claims in June, allowing consumers to recover compensation for robocalls, false advertising, data breaches and other legal issues.
$45M MGM Resorts data breach class action settlement
MGM Resorts International agreed to pay $45 million to resolve claims that it failed to prevent two data breaches in 2019 and 2023 that compromised consumer information.
The settlement benefits individuals who received a data breach notification from MGM informing them that their information may have been compromised in cybersecurity incidents in July 2019 and/or September 2023.
The MGM data breaches allegedly compromised sensitive consumer data, including Social Security numbers, driver’s license information, passport information and more. Consumers in the class action lawsuit argue that MGM should have done more to protect their information from the two data breaches.
The deadline to file a claim with the settlement is June 3, 2025.

$8.75M Feel Free Wellness Tonic class action settlement
Botanic Tonics agreed to pay $8.75 million to resolve claims that its Feel Free Wellness Tonic contains harmful ingredients.
The settlement benefits consumers who purchased Feel Free Wellness Tonic containing kratom between March 28, 2019 and March 5, 2025.
Botanic Tonics’ Feel Free Wellness Tonic reportedly contains kratom, a controversial opioid-like ingredient that is illegal in some states. Consumers say they were not informed that the ingredient could cause serious health risks and were misled into believing the products were a healthy alternative to alcohol.
The deadline to file a claim with the settlement is June 3, 2025.
$16.5M Avast data privacy FTC settlement
Avast agreed to a $16.5 million settlement with the Federal Trade Commission (FTC) to resolve claims that it shared consumer browsing data without first obtaining user consent.
The settlement benefits consumers who purchased antivirus software from Avast between August 2014 and January 2020.
According to the FTC lawsuit, Avast promised to protect consumer data but instead collected it to sell to third parties. Avast allegedly shared this information without obtaining consent or informing consumers.
The deadline to file a claim with the settlement is June 5, 2025.
$4M HP.com misleading discounts class action settlement
HP agreed to a $4 million settlement to resolve claims that it misled consumers by advertising fake discounts on its websites.
The settlement benefits consumers who purchased HP products at a discount on HP’s website between June 5, 2021, and Oct. 28, 2024.
According to the fake sale class action lawsuit, HP advertised its products at misleading discounts, tricking consumers into thinking they were getting a good deal. These misleading discounts allegedly caused consumers to spend more money on HP products than they would have otherwise.
The deadline to file a claim with the settlement is June 9, 2025.
$1.5M HALO BassiNest class action settlement
HALO Innovations agreed to pay $1.5 million to resolve claims that its BassiNest bassinet models can tilt due to a design defect affecting the sleep surface.
The settlement benefits consumers who purchased a HALO BassiNest Flex Morning Mist or HALO BassiNest Flex Heather Weave bassinet on or before Feb. 10, 2025.
The HALO BassiNest products allegedly have a design defect that can cause the sleep surface to tilt unexpectedly, putting babies at risk for rolling onto their sides or stomachs. According to the class action lawsuit, this defect could result in unsafe sleep where babies’ airways are obstructed.
The deadline to file a claim with the settlement is June 10, 2025.
Whirlpool, KitchenAid, Maytag refrigerator frost class action settlement
Consumers could benefit from a class action lawsuit settlement resolving claims that certain Whirlpool, KitchenAid and Maytag refrigerators are defective and suffer from excessive frost buildup.
The settlement benefits consumers who purchased certain Whirlpool, KitchenAid or Maytag refrigerators.
According to the class action lawsuit, the Whirlpool refrigerators suffer from a manufacturing defect that causes excessive frost buildup on the units’ evaporators. This defect and excessive frost buildup allegedly prevent the refrigerators from working and cooling as expected.
The deadline to file a claim with the settlement is June 18, 2025.
$3.6M Retina Group of Washington data breach class action settlement
Retina Group of Washington agreed to a $3.6 million settlement to resolve claims that it failed to implement cybersecurity measures that could have prevented a 2023 data breach.
The settlement benefits individuals whose personal information was accessed or potentially accessed in the Retina Group of Washington data breach on March 26, 2023.
According to the class action lawsuit, Retina Group of Washington failed to protect sensitive personal information, including Social Security numbers and health insurance data. Plaintiffs allege Retina Group of Washington could have prevented the data breach by implementing reasonable cybersecurity measures.
The deadline to file a claim with the settlement is June 23, 2025.
$1.8M UnitedHealth Optum robocalls class action settlement
UnitedHealth agreed to a $1.8 million settlement to resolve claims that it violated the Telephone Consumer Protection Act (TCPA) by using robocalls to market its Optum home care services.
The settlement benefits consumers who received robocalls from Optum Community Health Workers as part of the Optum at Home program between Dec. 11, 2019 and March 27, 2025, and who were not members or subscribers of UnitedHealthcare or who opted out of receiving calls from UnitedHealthcare.
UnitedHealth allegedly placed calls using artificial or prerecorded voices without obtaining consumer consent. According to the class action lawsuit, some consumers received these calls despite never being members or subscribers of UnitedHealthcare.
The deadline to file a claim with the settlement is June 24, 2025.
Sierra-at-Tahoe ski ticket class action settlement
Sierra-at-Tahoe agreed to pay an undisclosed sum to resolve claims that it failed to disclose parking restrictions when advertising single-day ski lift tickets online.
The settlement benefits consumers who purchased single-day ski lift tickets online for Sierra-at-Tahoe on Dec. 12, 14, 18-19 and 29, 2020; Jan. 9 and 30-31, 2021; and/or Feb. 6, 13 and 20, 2021, but were not able to use the tickets due to parking restrictions.
The class action lawsuit claims consumers were unable to use the Sierra-at-Tahoe tickets they purchased for specific dates due to undisclosed parking restrictions. Plaintiffs say that, had they been aware of the parking restrictions, they would not have purchased the tickets.
The deadline to file a claim with the settlement is June 24, 2025.
$4.42M DSW TCPA class action settlement
DSW agreed to pay over $4.42 million to resolve claims that it violated the Telephone Consumer Protection Act (TCPA) with unsolicited spam texts.
The settlement benefits individuals who received marketing texts from DSW after requesting not to receive future marketing text messages between Sept. 1, 2018, and Sept. 1, 2024.
DSW, a designer footwear company, allegedly sent unsolicited text messages without consumers’ consent. According to the class action lawsuit, DSW continued to send spam texts to consumers even after they opted out.
The deadline to file a claim with the settlement is June 30, 2025.
